Legal Snippets

SyncPro’s cloud platform allows hardware manufacturers to connect their devices to the cloud and collect data from these devices. While this data should not contain any private information and is only available to the manufacturer in an aggregated and anonymized form, it is still advised to formally inform your customers of this fact.

To simplify this for manufacturers, below are some optional paragraphs that can be added to your device EULA (end user license agreement) or to your company’s privacy statements.

Either way, SyncPro recommends that you consult with your legal team prior to connecting and collecting devices’ data.

  1. GENERAL

    • Software Registration. Registrations to the {Manufacturer} cloud service may require Licensee to register by providing certain contact information to {Manufacturer} and its service providers. {Manufacturer} may maintain a database of all such registered Licensees. By registering to the service, Licensee agrees to provide accurate information during registration.

    • Automatic Software Updates. {Manufacturer} Devices may communicate with {Manufacturer} servers from time to time to check for available updates to the Software, such as bug fixes, patches, enhanced functions, plug-ins, and new versions (“Automatic Software Updates”). By installing or using the Software, you agree to automatically request, receive, and accept such Automatic Software Updates, which are also subject to the terms of this Agreement.

    • Privacy Policy. As a condition of using the Device, you agree to the terms of the {Manufacturer} Privacy Policy at {https://.../privacy-policy}, which may be updated from time to time without notice but will in no event be less stringent than the current policy.

  2. DATA COLLECTION BY CLOUD PRODUCTS AND DEVICES

    • During operation, {Manufacturer} Devices may transmit data via the internet to {Manufacturer} and/or its third-party service providers. By default, information transmitted to the cloud is non-private information and only includes Devices’ technical information, usage analytics, etc.

    • Each device can be registered (or claimed) by or on behalf of an end user. Once registered (or claimed), the Device may periodically upload additional information to the {Manufacturer} cloud. This additional information may include: (a) Connected Device Information; (b) System Status Information including online status, reboot data, and software diagnostic events; and (c) a Device‐Level Events Log including commands received, detected environmental conditions, and data being transmitted and received by the Device.
